Terms of Use

01 Acceptance of Terms

By downloading, installing, accessing, or using the Athance mobile application or website at athance.kiventra.com (collectively, the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms") and our Privacy Policy.

If you do not agree to these Terms, do not download or use the Platform. Your continued use after any update to these Terms constitutes acceptance of the revised Terms.

02 About Athance

Athance is a sport-science athlete development platform developed and operated by Kiventra Technology & Media, a Bengaluru-based consulting and creative business (MSME Registered, Karnataka, India). Athance provides AI-powered coaching, performance analytics, ISSF-accurate scoring, leaderboards, and athlete management tools across multiple sport verticals, starting with Shooting.

Athance is not affiliated with, endorsed by, or an official product of the National Rifle Association of India (NRAI), the Karnataka State Rifle Association (KSRA), the International Shooting Sport Federation (ISSF), or any other governing body, unless explicitly stated in a signed partnership agreement.

03 Eligibility

To create an Athance account, you must:

• Be at least 13 years of age
• If under 18, have obtained verifiable parental or guardian consent
• Provide accurate and complete registration information
• Not be prohibited from using the Platform under applicable Indian law or the laws of your jurisdiction
• Not have had a previous Athance account terminated for violations of these Terms

Athletes registered through a state association or club by an administrator are subject to these Terms from the moment they first access the Platform, regardless of how their account was created.

04 Your Account

Registration

You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with another person. All activity that occurs under your account is your responsibility.

Accuracy

You must provide accurate, current, and complete information during registration and keep it updated. Providing false information — including misrepresenting your NRAI membership ID, shooting category, or age — is a violation of these Terms and may result in immediate account suspension.

Account Security

Notify us immediately at contact@kiventra.com if you suspect unauthorised access to your account. We are not liable for any loss arising from unauthorised use of your credentials.

One Account Per Person

Each individual may maintain only one Athance account. Creating multiple accounts to manipulate leaderboards, scores, or subscription tiers is prohibited.

05 User Roles & Permissions

Athance operates a role-based access model. Your role determines what data you can view, create, and manage:

Attempting to access data or functions outside your assigned role — including through technical means — is a material breach of these Terms.

06 Subscriptions & Billing

Plans

Athance offers a free Starter tier and paid subscription plans (Pro Athlete, Association) billed in Indian Rupees (INR). Current pricing is displayed on the Platform and in the Google Play Store listing.

Billing via Google Play

All paid subscriptions are processed exclusively through Google Play Billing. Athance does not directly handle or store your payment card details. By subscribing, you also agree to Google Play's terms of service and billing policies.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can manage or cancel your subscription at any time through Google Play Store → Profile → Payments & subscriptions → Subscriptions → Athance.

Refunds

Subscription fees are non-refundable once a billing period has commenced, except where required by applicable Indian consumer protection law. Refund requests for technical failures or billing errors may be submitted to contact@kiventra.com within 7 days of the charge.

Plan Changes

Upgrades take effect immediately. Downgrades take effect at the start of the next billing cycle. Deleting your account does not automatically cancel your Google Play subscription — you must cancel separately through Google Play.

07 Acceptable Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

• Submit false, manipulated, or fraudulent scores or session data
• Impersonate another athlete, coach, or association official
• Use the Platform to harass, abuse, or threaten other users
• Attempt to reverse-engineer, decompile, or extract source code from the app
• Use automated scripts, bots, or scraping tools to access Platform data
• Circumvent or tamper with any security, authentication, or access control feature
• Use the Platform in any manner that could damage, disable, or impair its infrastructure
• Upload content that is defamatory, obscene, or violates any third party's intellectual property rights
• Create multiple accounts to game leaderboard rankings or subscription limits
• Share your account credentials with any other person

Violations may result in immediate suspension or permanent termination of your account without refund, at Kiventra's sole discretion.

08 Your Content

Ownership

You retain ownership of all content you upload to the Platform — including training videos, session notes, and profile information ("Your Content"). You are solely responsible for the accuracy and legality of Your Content.

Licence to Athance

By uploading content, you grant Kiventra a non-exclusive, royalty-free, worldwide licence to store, process, and use Your Content solely to provide and improve the Platform's services to you. We do not use your training videos or personal content for marketing without your explicit written consent.

Performance Data

Your session scores, rankings, and performance analytics are yours. You may export them at any time via Settings → Privacy & Data → Export My Data. Anonymised, aggregated performance data (with all personal identifiers removed) may be used by Kiventra for platform benchmarking and improvement.

Prohibited Content

You must not upload content that is false, defamatory, offensive, or that infringes any third party's intellectual property or privacy rights. Kiventra reserves the right to remove such content without notice.

09 Intellectual Property

All intellectual property in the Athance Platform — including the app, website, logo, name, design system, AI models, ISSF scoring engine, FemmeSync module, NRAI dataset integration, and all software — is owned by or licensed to Kiventra Technology & Media. Nothing in these Terms grants you any right in Kiventra's intellectual property beyond the limited licence to use the Platform as described herein.

The "Athance" name, logo, and tagline "Train · Compete · Champion" are trademarks of Kiventra Technology & Media. You may not use them without prior written permission.

The NRAI dataset integrated into Athance is used under licence or public availability terms. It remains the intellectual property of the National Rifle Association of India.

10 AI & Coaching Features

AI-generated feedback is based on patterns identified in your session data and should be interpreted alongside guidance from a qualified human coach. Kiventra makes no warranty that AI coaching outputs are accurate, complete, or suitable for your specific training goals or medical condition.

By using AI coaching features, you acknowledge that:

• Results may vary based on data quality, lighting conditions, and device capabilities
• AI feedback does not constitute professional sporting advice
• You assume full responsibility for any training decisions made based on AI outputs
• Kiventra is not liable for any injury, underperformance, or loss arising from reliance on AI coaching features

11 FemmeSync — Cycle Intelligence Module

FemmeSync is an optional cycle-aware training module available to women athletes on the Pro plan. It provides training load and recovery recommendations based on menstrual cycle phase data you voluntarily provide.

• Use of FemmeSync is entirely voluntary and opt-in
• FemmeSync recommendations are not medical advice and do not replace consultation with a healthcare professional
• Your cycle data is treated as sensitive health information — see our Privacy Policy for full details on how it is stored and protected
• FemmeSync data is never shared with coaches, associations, or third parties without your explicit consent
• You may delete all FemmeSync data at any time from Settings → Privacy & Data

12 Associations, Clubs & Coaches

State associations, clubs, academies, and coaching organisations ("Organisations") that use Athance to manage athletes and competitions are subject to additional responsibilities:

• Organisations must obtain appropriate consent from athletes before adding them to the Platform
• Organisations are responsible for ensuring sub-junior athletes (under 18) have verifiable parental consent
• Competition scores published through Athance must be reviewed and approved by a designated official before being finalised on leaderboards
• Organisations may not use athlete data accessed through Athance for any purpose beyond managing their athletes' participation on the Platform
• Kiventra is not responsible for any dispute between an athlete and their club, coach, or association

Organisations operating under a custom Association plan are also bound by the terms of their separate service agreement with Kiventra, which takes precedence over these Terms where there is a conflict.

13 Third-Party Services

Athance integrates with or links to the following third-party services. Your use of these services is subject to their own terms and privacy policies:

• Google Play Billing — subscription and payment processing
• Supabase — database, authentication, and real-time data infrastructure
• Cloudflare R2 — video and asset storage
• Expo / EAS — app build and delivery infrastructure
• SCATT / SIUS — hardware scoring system integration (where applicable)

Kiventra is not responsible for the availability, accuracy, or practices of third-party services. Links to external websites are provided for convenience and do not constitute endorsement.

14 Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by Indian law, Kiventra disclaims all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Kiventra does not warrant that:

• The Platform will be uninterrupted, error-free, or free of viruses
• Scores, rankings, or AI outputs will be accurate or complete at all times
• The Platform will be compatible with all devices or operating system versions
• Any specific feature will remain available indefinitely

Athance is a training and performance tool. It is not a substitute for qualified coaching, medical advice, or official competition infrastructure. Always consult a qualified professional before making significant changes to your training regime.

15 Limitation of Liability

To the maximum extent permitted by applicable Indian law, Kiventra Technology & Media and its directors, employees, and contractors shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of scores, rankings, training data, or performance records
• Physical injury arising from following AI coaching recommendations
• Loss of subscription fees paid to Google Play
• Disputes between athletes, coaches, and associations on the Platform

Where liability cannot be excluded by law, Kiventra's total aggregate liability to you for any claim arising from these Terms or the Platform shall not exceed the total subscription fees you paid to Athance in the 3 months immediately preceding the event giving rise to the claim.

16 Termination

By You

You may stop using the Platform at any time and delete your account via the in-app Settings or by emailing contact@kiventra.com. See our Delete Account page for full details on data deletion.

By Kiventra

Kiventra reserves the right to suspend or permanently terminate your account, with or without notice, if you:

• Breach any provision of these Terms
• Submit fraudulent scores or manipulate leaderboard data
• Engage in conduct harmful to other users, coaches, or associations
• Fail to pay applicable subscription fees

On termination by Kiventra for breach, no refund of subscription fees will be provided. Your data will be handled in accordance with our Privacy Policy.

Effect of Termination

Upon termination, your licence to use the Platform immediately ceases. Sections 08 (Your Content — Licence), 09 (Intellectual Property), 14 (Disclaimers), 15 (Limitation of Liability), and 17 (Governing Law) survive termination.

17 Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The courts of Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Platform.

Informal Resolution First

Before initiating any legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at contact@kiventra.com. We will make a good-faith effort to resolve disputes within 30 days of receiving written notice.

Consumer Rights

Nothing in these Terms limits your rights under applicable Indian consumer protection legislation, including the Consumer Protection Act, 2019, or the Digital Personal Data Protection Act, 2023.

18 Changes to These Terms

Kiventra may update these Terms from time to time to reflect changes in the Platform, applicable law, or business practices. When we make material changes, we will:

• Update the "Last Updated" date at the top of this page
• Send an in-app notification to all registered users
• Email registered users at least 14 days before changes take effect

Your continued use of the Platform after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform and may delete your account.
